Information Gathering Portal: Terms of Use

D.A. Davidson & Co. ("D.A. Davidson") wishes to provide you (each person who elects to use the Information Gathering Portal, hereafter referred to as the "User"), with the ability to conveniently and securely provide information and documents to D.A. Davidson and its financial professionals through OneAdvisory, Inc. (doing business as Dispatch), a cloud-based portal for gathering information and documentation from you (the "Information Gathering Portal"). By using the Information Gathering Portal, User agrees to these terms and conditions, which may be updated from time to time.

User recognizes that there are inherent security risks in using the Information Gathering Portal yet considers that risk acceptable in exchange for convenience and increased security compared to other methods of sharing information and documents digitally. The parties therefore agree as follows:

  1. Consent to Use the Information Gathering Portal. By using the Information Gathering Portal, User consents to upload information and documents for review and download by D.A. Davidson and its financial professionals. User understands and acknowledges that any D.A. Davidson employee has access to the documents that User uploads to the Information Gathering Portal. User understands their use of the Information Gathering Portal is voluntary and not required for their engagement with D.A. Davidson.

    User understands and agrees the Information Gathering Portal should be expressly used for the secure and convenient upload of information and documents and any other use of the tool, including, but not limited to, uses described under "Improper Use" below, is unauthorized and may be subject to revocation of User's access to the Information Gathering Portal by D.A. Davidson.

  2. Use of the Information Gathering Portal. User is solely responsible for the information and selection of files uploaded to the Information Gathering Portal. All information and documents uploaded will be retained by D.A. Davidson and its financial professionals in accordance with financial industry record retention requirements and will not be accessible to the User on the Information Gathering Portal after submitted. As a result, User understands and acknowledges that they cannot rely on the Information Gathering Portal for the storage of any information or documents that are transmitted.

    The file size of uploaded documents cannot exceed 25 MB. File types supported through the Information Gathering Portal include: .jpg, .jpeg, .png, .tif, .tiff, and .pdf. To protect User's security, file types that are not allowed include, but are not limited to, scripts, databases, executable, and audio files.

    User will need certain hardware and software and may incur costs in connection with documents uploaded through the Information Gathering Portal. For example, User will need access to a computer with a web browser and email software to log in, input information and upload documents electronically. User must also have access to the internet. Further, User may incur costs such as internet provider costs. Such hardware, software and any other costs shall be User's sole responsibility and D.A. Davidson shall not be responsible for providing such hardware or software, or reimbursing User for any costs, to allow User to participate in the Information Gathering Portal.

  3. Improper Use. User understands and acknowledges that the Information Gathering Portal cannot be used to ensure that any time-sensitive communications are addressed in a timely manner. D.A. Davidson and its financial professionals do not accept orders to buy or sell securities via the Information Gathering Portal. Although User may discuss taxes, accounting and estate planning with their D.A. Davidson financial professional, D.A. Davidson and its financial professionals do not give tax, accounting or legal advice, and User must verify all information with their tax advisor, accountant and/or attorney.

  4. Electronic Security. User hereby acknowledges that the internet is not a secure communications network. Unauthorized parties may access communications transmitted over the internet. D.A. Davidson will not send to User any email that contains User's confidential information including, without limitation, User's tax ID, or social security number. User agrees to access the Information Gathering Portal directly through the link provided by D.A. Davidson’s financial professional.

  5. Authority. By continued use of the Information Gathering Portal, User also acknowledges that they have carefully read and agree to these Information Gathering Portal Terms of Use.
